TERMS OF USE
1. General Provisions
1.1. These terms regulate the use of the website www.mercuryestate.com (hereinafter – the “Platform”), which provides services for publishing real estate sale and rental listings based on a subscription model.
1.2. The Platform is not a broker, agent, or party to transactions between users. It solely provides technical means for publishing listings as described in clause 1.1 of these terms.
1.3. The Platform is not responsible for the accuracy of the information provided in listings, nor for any transactions conducted by users based on published listings.
1.4. Subscription payment constitutes payment for the listing service on the Platform and does not guarantee the sale or rental of a property.
2. Registration and User Responsibilities
2.1. Registration on the Platform is required to post listings. By creating a personal account on the Platform, the user fully agrees to these terms and must provide accurate, lawful, and up-to-date information.
2.2. The Platform reserves the right to delete or block listings that violate these terms.
2.3. A user may delete their personal account at any time by clicking the "Delete" button. All financial information stored in the account will be retained by the Platform until the expiration of the legally mandated storage period.
3. Subscription System and Payment
3.1. Posting listings on the Platform is available after paying for the selected subscription plan.
3.2. Available subscription plans vary in duration and cost, details of which are published on the Platform and during account registration.
3.3. Payments can be made via bank cards through integrated payment systems on the Platform, as well as Google Pay and Apple Pay. Users can view and download invoices in PDF format at any time in the "Finance" section of their personal account.
3.4. Subscription fees are non-refundable after a listing is published. However, users may edit or replace listings within the active subscription.
3.5. All Platform service fees include value-added tax (VAT), applicable under the laws of the Republic of Latvia. Listing publication is considered a service rendered within Latvia; therefore, VAT payment is mandatory, including for non-residents.
3.6. No separate fees are charged for inquiries.
4. Limitation of Claims and Refunds
4.1. Subscription extension is only possible in the event of technical failures that caused listing unavailability for specific hours.
4.2. The Platform is not responsible for the absence of expected results (e.g., if a property is not sold or rented).
4.3. In case of chargebacks, the Platform reserves the right to block the user’s account until the issue is resolved.
5. Limitation of Liability
5.1. The Platform does not verify the information provided in listings and does not guarantee its accuracy.
5.2. The Platform is not liable for any losses resulting from the use of listing information.
5.3. The Platform reserves the right to remove listings and block user accounts that violate these terms.
5.4. In case of violations of these terms, Latvian laws, intellectual property rights, or if damages, discomfort, or inconvenience are caused to third parties, the user bears full material responsibility for the content of their listing before both the Platform and third parties.
5.5. The Platform is not responsible for the content of inquiries sent by users regarding published properties. All such inquiries reflect the personal opinion and initiative of users. Responsibility for the accuracy and reliability of information in inquiries lies with their senders.
5.6. The Platform has the right to block senders of inquiries at the advertiser’s request after moderator review if the inquiry violates the following rules:
5.6.1. Ethical standards — inquiries containing insults, threats, discrimination, or violating principles of respect and integrity;
5.6.2. Legal standards — inquiries containing illegal content or requests for unlawful actions;
5.6.3. Platform terms of use — inquiries violating Platform terms, including spam, unfair competition, or fake inquiries;
5.6.4. Privacy — inquiries violating personal data or requesting personal information without consent.
6. Tax and Legal Aspects
6.1. Income generated from the Platform may be subject to taxation under the user's local laws.
6.2. The user is solely responsible for paying taxes related to transactions made through the Platform.
6.3. The jurisdiction for all legal matters is the Republic of Latvia. Disputes between the Platform and the user shall be resolved through negotiation or, if that fails, in accordance with Latvian law.
7. Organizational Rules
7.1. Users may edit listings after publication on the Platform.
7.2. Legal entities may delete and add new listings based on their selected subscription.
7.3. Listing duration depends on the selected subscription plan.
7.4. Listing costs depend on the subscription plan and client type (legal or private person). All prices are displayed on the Platform.
7.5. Listings that do not comply with these terms will be blocked by a moderator. After corrections are made, the moderator may reactivate the listing without extending its publication period.
7.6. If a listing was deactivated by a moderator due to a violation, the user has the right to contact the Platform to clarify the reason and discuss the possibility of reinstatement via sale@mercuryestate.com.
7.7. All visitor inquiries are available for free in the user’s personal account under “Inquiries”. Users also receive email notifications. Client contact details (name, phone, email) are included in the inquiry. Users can contact the client directly.
8. Listing Requirements
8.1. Listings are not accepted if they:
8.1.1. Violate laws, ethical standards, or commonly accepted norms, or contain prohibited or illegal content;
8.1.2. Contain incorrect or erroneous data;
8.1.3. Are posted in the wrong categories;
8.1.4. Include contact details (phone, email, links, etc.) in the text, except in designated fields;
8.1.5. Contain low-quality photos that do not adequately present the property;
8.1.6. Have bright backgrounds, unnatural colors, or distracting elements;
8.1.7. Contain watermarks, logos, contact details, or collages;
8.1.8. Use all caps (Caps Lock);
8.1.9. Use marketing phrases such as "Promotion", "Special Offer", "Unique Price", etc., designed to attract attention in general listings;
8.1.10. Infringe copyright or trademarks;
8.1.11. Are in languages other than Russian or English, or use transliterated Russian with grammatical errors;
8.1.12. Receive multiple complaints (at least three in a month);
8.1.13. Have unfilled mandatory fields (marked with “*”);
8.1.14. Duplicate the same property by the same advertiser;
8.1.15. Are fraudulent;
8.1.16. Contain outdated information or unavailable properties.
8.2. To comply with EU laws and ensure transparency, listing properties located in countries subject to EU sanctions is strictly prohibited. This includes properties in territories with limited international recognition or under restrictive international measures. The user bears responsibility for the accuracy of the property’s location. If violations are found, the Platform reserves the right to:

immediately remove the listing without prior notice;

temporarily or permanently block the user from posting new listings;

report the information to the relevant authorities if required by law.

8.3. The listed price of the property must not be lower than the minimum price shown on the Platform.
8.4. Each listing must offer only one property with an accurate price and detailed description.
8.5. Legal entities (or users who have purchased a subscription) may publish listings under their plan, limited to 50 properties. Private users may post an unlimited number of properties. Each listing must be paid separately.
8.6. A maximum of 15 photos is allowed per listing. Each photo must be under 5 MB. Accepted formats: JPG, JPEG, PNG. Listings with low-quality images, collages, or images with text may be blocked without a refund. Users may also include a YouTube video link (e.g., https://youtu.be/83dOsZJGEDo?feature=shared) in the “Full YouTube link” field.
8.7. The listing title must be informative and attention-grabbing. It should start with a capital letter and not end with punctuation.
8.8. The listing description should not duplicate the title or property features. Excessive use of styling (e.g., bold or italic) is not allowed; the text must be readable.
8.9. Outdated listings are prohibited. Repeated violations may result in account suspension without a refund.
8.10. Legal entities may replace properties within the base package during the subscription period. Private users may not replace properties.
9. Statistics
9.1. Users have access to property view statistics in their personal account under “Statistics”, where they can track interest over the last 3 months. They can see the number of views and user activity for each property.
9.2. Once a week, the Platform emails a summary of statistics including views and inquiries received for the user’s properties over the past week.
10. Final Provisions
10.1. The Platform reserves the right to amend these terms with prior notice to users. Notification is sent via the personal account.
10.2. The user may terminate the agreement with the Platform and delete their account within 15 days before the changes take effect. In this case, any unused subscriptions will be refunded within 14 days from contract termination. Continued use of the Platform after changes take effect signifies acceptance.
10.3. The effective date of the current version of the terms is published on the Platform.
10.4. The Platform has access to users’ personal data submitted to use Platform services. For more information, refer to the Privacy Policy published on the Portal. Users must read the Privacy Policy before making payments.
10.5. Platform contact details are available in the “Contacts” section.
10.6. If users have questions about the Platform services, they can check the “Help” section in their personal account. If information is not found there, users can contact Platform representatives via email at sales@mercuryestate.com.
