The process of buying property in Slovenia
About the purchase process
Slovenian law does not allow foreigners who are not EU citizens to buy local real estate as individuals. Russians, Belarusians, Ukrainians and Kazakhstanis can become owners of objects in Slovenia only as legal entities, that is, having previously registered a company in the country and acquiring an object for it.
The most popular form for investors is a limited liability company (družba z omejeno odgovornostjo - d.o.o.). The requirement cannot be bypassed.
Foreign citizens who have opened a company in Slovenia have no restrictions. They can buy real estate of any type - houses, apartments, land - throughout the country.
There are only special additional procedures and checks in case of acquiring agricultural land in Slovenia. The requirement applies to all foreign nationals, including EU residents. However, cases when a foreigner wants to acquire agricultural land are very rare.
Rights of foreign property owners
The purchase of real estate is not a basis for obtaining a residence permit in Slovenia.
The main requirement is that the property must be registered to the company in which the investor is employed as a director. The business should not be “fake”, that is, it will not work to open a company with a zero balance and report “inactivity” annually.
Only in the case of real work, a foreign investor will subsequently receive the right to obtain a residence permit.
After five years, the applicant can apply for a permanent residence permit.
Obligations of foreign property owners
A foreigner, as the owner of a company, needs to keep accounting records, submit an annual balance sheet and pay taxes on the company - income tax, VAT, and so on. A foreigner who becomes a tax resident of Slovenia must also report his worldwide income.
If he is not a resident of Slovenia, but, for example, remains a resident of Russia, taxation is formed on the basis of an agreement between the countries.
